NBA Demands Investigation, Suspension of New Tax Reform Acts Over Due Process Concerns

 

The Nigerian Bar Association raises alarm over alleged procedural breaches, transparency gaps, and constitutional issues in the passage of the controversial tax reform laws

The Nigerian Bar Association (NBA) has called for the immediate investigation and suspension of the recently enacted Tax Reform Acts, expressing deep concerns over the integrity, transparency, and constitutional validity of Nigeria’s lawmaking process.


In a strongly worded position, the NBA warned that the manner in which the tax reforms were passed raises serious questions about adherence to legislative due process and the rule of law. The association noted that laws with far-reaching economic and social implications must undergo rigorous scrutiny, broad stakeholder consultation, and full compliance with constitutional requirements.


According to the NBA, the speed and procedure surrounding the passage of the Tax Reform Acts have triggered fears of potential procedural irregularities, inadequate public engagement, and possible violations of constitutional safeguards designed to protect citizens’ rights and democratic accountability.


The association stressed that taxation laws, in particular, demand the highest level of transparency, as they directly affect businesses, professionals, and ordinary Nigerians. It cautioned that any perception of impropriety or exclusion in the legislative process could erode public trust and undermine confidence in governance.


The NBA therefore urged relevant authorities to halt the implementation of the Tax Reform Acts pending a comprehensive, independent investigation into the legislative process that produced them. It also called for a thorough review to ensure that the laws align with constitutional provisions and reflect the interests of the Nigerian public.


Reaffirming its commitment to the rule of law, the Nigerian Bar Association stated that it would continue to speak out against any action that threatens constitutional order, democratic principles, or the credibility of Nigeria’s legal and legislative institutions.
