A US criminal judge has warned that information deleted from a cellphone may not necessarily disappear completely and could potentially be recovered and used as evidence in legal proceedings.

“If you delete something from your phone, it’s not really deleted. Cellphone records even after being deleted can be used as evidence against you,” the judge said.

The warning highlights the importance of understanding that digital information can sometimes remain recoverable through forensic examination, depending on the device, application, backups and other circumstances.

Deleted messages, photos, files and other digital records may also exist in cloud backups, linked devices, service-provider records or other systems, depending on how the information was stored and processed.

The comments have sparked reactions online, with many social media users expressing surprise at how much digital information can potentially remain accessible even after it has been deleted from a device.

The development underscores the growing role of digital forensics and electronic evidence in modern criminal investigations and court proceedings.
